Training activity: “Procedural position of the Commissioner for Protection from Discrimination to the Court.”

The School of Magistrates, on 19 December, 2024, has at the School of Magistrates, the training activity on topic:

“Procedural position of the Commissioner for Protection from Discrimination to the Court. The nature of the decisions of the Commissioner for Protection from Discrimination. ECtHR and ECJ practice, practice of the courts in the Republic of Albania regarding the principle of parity and non-discrimination.”

The purpose of this training is: 

The understanding of specific points of the issues with object discrimination, through prsctices of the Albanian and international courts. 

The training will be realized by combining presentations (up to 20 - 30 min) with the discussion of issues brought for discussion (self-study questions, questions, answers) and case law exercises & quizzes to encourage and realize the active interaction of participants.  

In this training activity will be elaborated different topics, such as:  

• The procedural position of KMD in judicial processes. The nature of the KMD decisions. 
• ECtHR practice on the prohibition of discrimination as well as on the nature of  KMD.
• The passing of the burden of evidence and rewards in issues with object discrimination according to the practice of the Albanian courts.
• ECJ jurisprudence regarding equality and non-discrimination. 

In this training activity participate judges, prosecutors, officers of the judicial police, state advocates of the Republic of Albania.
