PUBLIC STATEMENT
ON SOME UNTRUE DECLARATIONS AND CLAIMS MADE AT THE MEETING OF THE HIGH PROSECUTORIAL MEETING OF THE DATE 10 JUNE 2024
The School of Magistrates expresses its concern that untrue declarations and claims made at the plenary meeting of the High Prosecutorial meeting, on the process of recruitment done in April, 2024, are a serious violation of the activity of the School of Magistrates, an attack on its independence, and an attempt to denigrate its authority, to cause the direct consequence of throwing mud at the competitors, future magistrates, that through their merit are declared winners in this competition.
The School of Magistrates guarantees that the process of the recruitment of candidates for magistrate has always been a process based completely on merit, independent and in complete harmony with law. The School has taken all the measures to know and consider the merit of competitors only and on the basis of their knowledge and professional capacities. Winners are considered such by an independent Commission that is behaved and will always behave professionally.
Participants in competition enjoy and exercise all the rights recognized by the law and the Internal Regulation of the School of Magistrates.
We consider as essential, this merit and transparency process, for the education of the independence and integrity of future judges and prosecutors, so it has remained and will remain the same. This element is the basis of future judicial system.
The School will continue to encourage with responsibility the stability and integrity of the system of the selection of future judges and prosecutors, because we believe essentially on the equality of chances of participating candidates, as a basic principle of the democratic system.
Malicious insinuations, for irregularities or for the declaration as winners of competitors without merit, do not have any legal or factual support, but are attempts to damage the School of Magistrates, the system of justice and to violate public trust in justice.
Continuous attacks are organized through all the years of the activity of the School of Magistrates, as a habit expression of the attempts that intend the keeping of the system of justice and of its members, slandered, degraded and subjugated. These attempts have received an answer with determination, impartiality, integrity and the professionalism shown by the School.
The School of Magistrates has contributed, assisted and supported the Justice Reform, has done commendable attempts to facilitate and supply the judicial service along the years of the implementation under the civilian and professional responsibility for its success. And will continue to do it, reflecting for the whole judicial system the example of independence, dignity and professionalism. We think that the essence of the Justice Reform has remained exactly on these primary elements that intend to be nourished to our members of the system starting from the merit in their selection.
The School of Magistrates will continue to contribute in major professional and legal projects that the country needs, such as the final contribution in the drafting of the new project of the Criminal Code of the Republic of Albania. We wish that the successful project, submitted to the Ministry of Justice may find as soon as possible the legal way of its discussion for the benefit of the criminal justice system of Albania.
Criminal claims done versus the Director of the School of Magistrates, in the meeting of the High Prosecutorial Council, represent a serious concern for the functioning of the highest bodies of the system of justice and for the protection and the respect of human dignity. They reflect the lack of respect for the most important institutions of the Albanian state; intend to threaten anyone that with responsibility and professionalism does not become part of illegitimacy, intending to make justice with his/her work.
Disturbing for every member of the system of justice, including also the constitutional justice, is the upside – down, offensive and non-ethical presentation of the legal fact of the dismissal from duty of the General Prosecutor, actually the Director of the School of Magistrates. The actual Governing institution of Prosecution accepts on its official table, the malicious treatment of the judicial fact, one of the most serious ones in the history of the Albanian parliamentarianism, that of the violation of the Constitution of the Republic of Albania, confirmed by the Constitutional Court of the time.
The not knowing, lack of information or the misuse of that legal fact, weighs on anyone who is part of the governance of today’s Prosecutor’s office. The governing body of Prosecution according to the law has the right to protect the independence, integrity, or the dignity along the exercise of the duty, to respect the constitutional and legal system of norms and the constitutional or judicial hierarchy of organs and, not to allow, but to distance from the moral, cultural, professional or logical – emotional degrading of everyone that can influence on the governance of the system. The complete non-understanding of the fact, even when it is written clearly the black on the white, is non-justifiable for every practitioner, even for those who are beginners, of law, either in the case of having political aims to accomplish, career intentions or even simply, personal ones.
The School of Magistrates will continue to support the High Prosecutorial Council and the Prosecution of the Albanian State to achieve the aims of its independent activity, legal and equal for all.
