17.02.2025 - Training activity: “Gender based violence”

The School of Magistrates, in cooperation with the Center for Legal Civic Initiatives, QNL, on 17 February, 2025, had at the School of Magistrates the training activity on topic: “Domestic violence according to the Article 130/a of the Criminal Code.  The amendments of the provision and the report with the law on domestic violence. Interpretation of terms “closes gender” and “close intermarriage”. Different judicial points regarding the circle of family members that are subject of the criminal offense of domestic violence. Interpretation of qualifying circumstance “more than once” and “in the presence of children” according to the fourth paragraph of the Article 130/a of the Criminal Code.   International anticipations and judicial practice.”

The purpose of this training is: 

The updating of participants in training with international standards, international and domestic practice regarding the criminal offence of domestic violence. 

The training will be realized by combining presentations (up to 20 - 30 min) with the discussion of issues brought for discussion (self-study questions, questions, answers) and case law exercises & quizzes to encourage and realize the active interaction of participants. 

In this training activity will be elaborated different topics, such as: 

• The interpretation of terms “near gender” and “near intermarriage”. Different judicial practices regarding the circle of members of family that are subject of the criminal offense of domestic violence;
• Interpretation of terms of the qualifying circumstance “more than once” and in the presence of children, according to the fourth paragraph of the Article 130/a of the Criminal Code and study in statistical form for the criminal offence foreseen by the Article  130/a/4  in years;
• Presentation of international practices and the evidencing of problems of the application of Article 130/a of the Criminal Code in our judicial practice.

In this training activity participated judges, prosecutors and officers of the judicial police of the Republic of Albania.
