19.06.2025 - Training activity: “Extradition. Conditions of extradition, application of the prosecutor and the procedure for the execution of extradition.”

The School of Magistrates, on 19 June, 2025, had the training activity on topic: “Extradition. Conditions of extradition, application of the prosecutor and the procedure for the execution of extradition. Consequences of the non-respect of the legal terms regarding the execution of extradition procedures. Cases of the non-accepting of extradition. Legal amendments regarding the taking of the in effect form of the extradition decision. Simplified extradition and its application in practice.”

The purpose of this training is:  

Theoretical and practical treatment of extradition and its conditions. Explanation of the procedure of extradition, from the presentation of the application, the attitude of the Ministry of Justice, investment of the court from prosecution, judicial examination, up to the execution of the decision with which eventually is accepted the application for the permission of extradition; comparative analysis regarding legal changes related to the taking of the final form of the decision of extradition. 

The training was realized by combining presentations (up to 20 - 30 min) with the discussion of issues brought for discussion (self-study questions, questions, answers) and case law exercises & quizzes to encourage and realize the active interaction of participants.  

In this training activity were elaborated different topics, such as: 

• International standards and jurisprudence of ECtHR, on the role and obligations of courts for the consideration of extradition applications;  
• Constitutional and High Court jurisprudence in the treatment of cases of extradition, according to bilateral agreements;
• Conditions of extradition, application of the prosecutor and procedures for extradition. Consequences of the non-respect of legal terms regarding the accomplishment of extradition procedures; 
• Issues of the application of our legislation on extradition, conditions and extradition stops, procedures of the approval and of the execution of extradition. Cases of the refusal of extradition. 

In this training activity participated judges and prosecutors of the Republic of Albania.
