28.02.2025 - Training activity: “Expropriation in the context of public interest and limits of the correct defense of ownership; the principle of the fair reward”

The School of Magistrates, on 28 February, 2025, had in Tiranë the training activity on topic: 

“Expropriation in the context of public interest and limits of the correct defense of ownership; the principle of the fair reward.”

The purpose of this training is: 

The elaboration and updating of knowledge on constitutional and legal concepts for the definition of the concept of property law in cases of expropriation. The capacitating of magistrates and of other participants in the training, on aspects of the institute of expropriation in the context of public interest.   

The training was realized by combining presentations (up to 20 - 30 min) with the discussion of issues brought for discussion (self-study questions, questions, answers) and case law exercises & quizzes to encourage and realize the active interaction of participants. 

In this training activity will be elaborated different topics, such as: 

• The juridical nature of expropriation for the effect of a public interest. Its importance and effects. 
• Concept of legal expropriation for the effect of public interest.
• The principle of fair reward. 
• Aspects of financial evaluation of the expropriated property.
• The concept of factual expropriation (indirect expropriation).
• Juridical instruments in report with property law and the right of reward. 
• Expropriation and legalisation. 
• The term of lawsuit prescription. The moment of the arising of the right of administrative lawsuit for the opposition of the value of property, object of expropriation.
• The perspective of the administrative courts and of the Administrative College. 
• The treatment of practical aspects referring to the jurisprudence of the Albanian courts and of the ECtHR in the treatment of aspects related to the institute of expropriation for public interest. 
• Comparative view with the European legislation and practice of foreign courts.

In this training activity participated legal advisors and state advocates of the Republic of Albania.
