30.05.2025 - Training activity: “Competences of courts of common jurisdiction regarding special issues of the procedure of arbitration.”

The School of Magistrates, on 30 May, 2025, had the training activity on topic: “Competences of courts of common jurisdiction regarding specific issues of the procedure of arbitration; appointment of arbitrators when parties disagree; the taking of temporary measures when the court of arbitration is not formed yet; the examination of the application for the annulment of the decision of the arbitration court.”

The purpose of this training is: 

To consolidate their knowledge and capacities regarding the interaction between common and arbitration jurisdiction, being focused on specific issues where the interference of courts is essential. The training aims to explain the role of courts in the appointment of arbitrators, when parties do not come into an agreement, in the giving of temporary measures in the preliminary phases of the arbitration process, as well as the examination of applications for the annulment of decisions of the court of arbitration. So, training assists in the providing of a fair and efficient application of the law on arbitration, by increasing the quality of judicial decision-making in this ground.  

The training was realized by combining presentations (up to 20 - 30 min) with the discussion of issues brought for discussion (self-study questions, questions, answers) and case law exercises & quizzes to encourage and realize the active interaction of participants. 

In this training activity were elaborated different topics, such as:

• Innovations of law no. 52/2023 “On arbitration in the Republic of Albania.” National and international arbitration. 
• Judicial jurisdiction and that of arbitration. Exclusive jurisdiction of the Albanian courts. The clause of arbitration (compromissory clause) and its validity;  
• Competences of courts of common jurisdiction regarding specific issues of arbitration procedure; appointment of arbitrators when parties disagree; the taking of temporary measures when the court of arbitration is not formed yet; examination of the application for the annulment of the decision of the court of arbitration. 

In this training activity participated judges, prosecutors, and state advocates of the Republic of Albania.
