Training Activity on topic, “Legal changes for cases of the immediate leave of the violator from the apartment (Law 125/2020).”

In the context of the Program of Continuous Formation, the School of Magistrates organized on 11March, 2024, the training activity on topic:

“Legal changes for cases of the immediate leave of the violator from the apartment (Law 125/2020), on the proper defense of the survivors of gender-based violence, of domestic violence of harmful practices as well as for other changes of the legal framework for the treatment of cases of gender-based violence in continuity. The application of the improved legal framework to support women at risk and to prevent child early marriages.”

The panel in this training activity is composed of:

• Arta Marku, expert;
• Ornela Naqellari, expert;  
• Ervisa Hyka, facilitator. 

The main purpose of this training activity is as follows: 

• To be discussed domestic violence as one of the cases of gender-based violence; 
• Definition and meaning of the term “victim” in the criminal aspect; 
• Determination of the term “violence” in the criminal aspect; 
• The rights of the victim and of her heirs. 

In this activity were elaborated various topics such as:

• The meaning and definition of the terms, “victim, accusing victim, plaintiff and civil defendant. Also, was discussed if there is a relationship between the issuing of the immediate order of protection and the summons for criminal investigation.
