Training Activity: Problems related to the co-ownership of the agricultural family, the legitimacy of the representation of the head of the family and members in legal actions

In the context of the Program of Continuous Formation, the School of Magistrates organizes on 7 February 2023 the activity on topic:

“Problems related to the co-ownership of the agricultural family, the legitimacy of the representation of the head of the family and members in legal actions. The effects of the increase or decrease of the family on the property in co-ownership and nature of its division.”

In this activity were elaborated various topics such as:

What are the characteristics of the legal regime of the agricultural land under the law, on the land? To which legal relationships extends the right of the head of the agricultural family to represent the last one in property relations with the thirds? Is AMTP an ownership title?
Up to what legal relationships should act the family head in the enforcement of the law, on the land?
What is the passive litigation in lawsuits with object ‘the declaring of invalidity’ of AMTP, presented by the KVTP to the District Prefect?
What are the characteristics of the co-ownership between members of the agricultural family under the Civil Code of the Republic of Albania?
What are the consequences of changes of the family composition for the formation of passive litigation in the above lawsuits?
Is the child born after the year 1991, member of the agricultural family under the law, on the land? Disposition on requests for which is required authorization for the alienation of the property of the agricultural family received due to the law, on the land, for children born after the year 1991.

The main objective of the training is as follows:

To identify problems of judicial practice in relation to the co-ownership of the agricultural family, intending to have similar solutions of them.

In the training is elaborated as follows:

Legal status of the agricultural family; (and)
The fact that the agricultural family does not enjoy legal personality as a special subject of the civil law;
The role of the family – head in relation to members of the agricultural family; (as well as)
The change of the number of members because of births, marriages, etc.
